These Terms & Conditions ("Terms") govern your use of the ApexHQ platform and services. By accessing or using ApexHQ, you agree to be bound by these Terms. If you do not agree, do not use the platform.
By creating an account, subscribing to a plan, or accessing any part of the ApexHQ service, you confirm that you are at least 18 years of age and have the legal authority to enter into this agreement. These Terms apply to all users of the platform, including individual climbers, guided groups, and commercial operators.
ApexHQ is an AI-powered acclimatization monitoring platform designed for the outdoor and adventure market. The platform ingests wearable data (SpO2, HRV, altitude, sleep, hydration, nutrition) and generates real-time risk assessments for altitude illness (AMS, HAPE, HACE) to support decision-making during high-altitude expeditions.
ApexHQ is a data aggregation and analytics tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
APEXHQ IS A DECISION-SUPPORT TOOL ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, CLINICAL DIAGNOSIS, OR TREATMENT BY A QUALIFIED HEALTHCARE PROVIDER. The risk scores, alerts, and recommendations generated by ApexHQ are based on algorithmic analysis of user-reported and device-reported data. They are not medical determinations.
Altitude illness (AMS, HAPE, HACE) is a serious and potentially life-threatening condition. If you or any member of your expedition experiences symptoms of altitude illness, descend immediately and seek professional medical care. Do not rely solely on ApexHQ alerts to make medical decisions. When in doubt, descend.
ApexHQ, its operators, agents, and affiliates shall not be held liable for any medical decisions made based on information provided by the platform.
To the maximum extent permitted by law, ApexHQ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, use, goodwill, or other intangible losses — resulting from:
Our total liability for any claim arising from use of the platform shall not exceed the total amount you paid to ApexHQ in the 12 months preceding the claim.
The ApexHQ name, logo, platform, software, algorithms, risk scoring models, and all associated content are the exclusive property of ApexHQ. You may not reproduce, distribute, modify, or create derivative works from any ApexHQ materials without prior written consent. "ApexHQ" and related marks are trademarks of ApexHQ.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that endangers others. You may cancel your subscription at any time through your account settings or by contacting us at support@apexhq.com. Upon termination, your right to access the platform ceases immediately.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which ApexHQ operates. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
